1. Binding Agreement

These General Terms and Conditions (the "Terms") constitute a legally binding agreement between you ("the User") and Golden New Zealand AI. By accessing https://goldennewzealandai.org or utilizing our AI-driven services, you expressly agree to comply with these Terms.

2. Nature of Service (No Financial Advice)

Golden New Zealand AI provides a technical infrastructure for data aggregation, AI-driven visualization, and predictive indicators.

No Regulated Advice: We do not provide regulated financial advice under the Financial Markets Conduct Act 2013. Our AI outputs are purely informational and do not constitute a recommendation to acquire or dispose of any financial product or digital asset.

Independent Decision-Making: All trades, investments, or market actions taken by the User are performed at the User’s sole discretion and exclusive risk.

3. Risk Disclosure and Volatility

The User acknowledges that:

Market Volatility: Financial and digital asset markets are subject to extreme and unpredictable price fluctuations.

AI Limitations: Past performance and algorithmic probabilities are not indicators of future results. AI models may be subject to "hallucinations" or inaccuracies based on unforeseen market events.

Capital Loss: There is an inherent risk of total capital loss when engaging in market activities.

4. Intellectual Property and Prohibited Conduct

The entire platform, including its neural architecture, algorithms, source code, and design, is the exclusive property of Golden New Zealand AI. Users are strictly prohibited from:

Reverse-engineering or attempting to extract the underlying AI models.

Using automated scrapers or bots to harvest data from the platform.

Utilizing the platform for any activity that violates the Harmful Digital Communications Act 2015.

5. Limitation of Liability

To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act 1993 where applicable), Golden New Zealand AI shall not be liable for any losses arising from technical downtime, API latency, algorithmic errors, or market-driven financial losses.

6. Governing Law

These Terms are governed by and construed in accordance with the Laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the Courts of New Zealand.
